1. Acceptance of Terms

By downloading, installing, or using the Chess 3D application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Chess 3D is a 3D chess game application developed by GR Costa ("Service Provider", "we", "us", "our") for mobile devices and desktop computers. The App provides:

- 3D chess gameplay with traditional and extended rules

- AI opponents with varying difficulty levels

- Game Center functionality

- Game statistics and learning features

- Premium subscription features

3. User Eligibility

You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

4. User Accounts and Responsibilities

4.1 Account Security

- You are responsible for maintaining the security of your device and any associated accounts

- You agree not to share your account credentials with others

- You must notify us immediately of any unauthorized use of your account

4.2 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

- Reverse engineer, decompile, or disassemble the App

- Attempt to gain unauthorized access to our systems

5. Subscription Services

5.2 Subscription Terms

- Subscriptions are available on a monthly or yearly basis

- All subscriptions include a 7-day free trial period

- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

- Payment will be charged to your Apple ID account upon confirmation of purchase

- Subscription fees are non-refundable except as required by law

5.3 Cancellation

- You may cancel your subscription at any time through your Apple ID account settings

- Cancellation will take effect at the end of the current billing period

- You will retain access to premium features until the end of your current billing period

5.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated to you in advance and will apply to your next billing cycle.

6. Intellectual Property Rights

6.1 Ownership

The App and all its content, features, and functionality are owned by GR Costa and are protected by Australian and international copyright, trademark, and other intellectual property laws.

6.2 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to:

- Download and install the App on up to two devices

- Use the App for personal, non-commercial purposes

- Access premium features if you have an active subscription

6.3 Restrictions

You may not:

- Copy, modify, or distribute the App

- Create derivative works based on the App

- Remove any proprietary notices or labels

- Use the App for commercial purposes without written permission

- Your use of the App

10. Termination

10.1 Termination by You

You may terminate your use of the App at any time by deleting the App from your device and cancelling any active subscriptions.

10.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

- Violation of these Terms

- Fraudulent or illegal activity

- Discontinuation of the App

10.3 Effect of Termination

Upon termination:

- Your right to use the App ceases immediately

- You must delete the App from all your devices

- We may delete your account and associated data

- Provisions that by their nature should survive termination will remain in effect

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of Australia, without regard to conflict of law principles.

11.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration.

- Displaying a notice in the App

Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Sever-ability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GR Costa regarding the App and supersede all prior agreements and understandings.
